The basis behind this video is EXACTLY what America is these days.

What do you guys think wal-mart is? There are Wal-marts within a 50mile radius of each other across the nation now, putting mom/pop businesses out of business because they have more money. Obviously there's more logistics behind it, however that is essentially what it all boils down to.

First off, i plan on following the links and hopefully sending in an email to monster. I know it would jeopardize the legitimacy of my letter, but i would love to tell monster that their "business ethics" are so f**kED.

Secondly, Phntm, i think things are a bit different with walmart. the mom and pop stores shut down because of competition. I'm not saying i like it, but thats just how that happens.

I would like to begin by saying that you make a very popular, quality beverage in Monster Energy. I have enjoyed your product many times in the past. Unfortunately for you, never again will I, or many other whom I have spoken to, purchase or consume your products. This is due to the absolute LACK of ethics and moral value your company possesses. By now I would hope you have determined that I am writing in reference to your ridiculous cease & desist order against Rock Art Brewery. It is unbelievable that a company who clearly states on their website that "We set high ethical and moral standards. We will not engage in or support any act that is unethical or illegal." would attempt this type of action. I suppose your definition of "high" is what most people would consider "non-existent" It saddens me to know that your company has such little regard for the well-being of the 9 employees (not to mention their families) of Rock Art Brewery. Your beverages are no where NEAR similar, yet you feel the need to assert your power in the beverage world by forcing them to change their name or fight you in court. Your company has the assets to do battle in court, theirs does not, and if you insist on taking them to court, you will more than likely bankrupt their entire company. Your "ethics" are a joke. I hope there are people out there with the ability to fight on the side of Rock Art Brewery against a corporation whose integrity is so minuscule.

I understand that it's a different scenario, however in the big picture it's the same concept.

Money will buy their way into and/or out of anything with big corporations, and ruin the backbone of America; is the overall point.

Technically, there is NO infringement what-so-ever.

None.

Rock Art Brewery will win ever case.
But that's not Monster's purpose for suing for infringement.

Like they said. They will just appeal all day, until Rock Art Brewery is broke.
Monster's strategy is to make him financially incompetent to continue with court. Even though he wins the cases (which will be moved up, when appealed), he will lose by default when he can't afford it anymore.

Monster energy drink and Monster beer are totally different products. But Monster cannot enter the alcohol/beer field, because Rock Art Brewery owns the trademark 'Monster Beer'. So, they are basically trying to run him to the floor financially to the point that he HAS to change his name. Even if there's no infringement what-so-ever. Monster just wants to make beer, and name it Monster Beer. Rock Art is basically blocking them.

Monster KNOWS their product is no where near similar. They want to enter the beer business, but they can't name it Monster Beer, because of Rock Art Brewery.

EDIT: It's a very unmoral like move. If Monster was a good company, they would pay royalties and or pay for the name. But Rock Art, probably wouldn't give up the name. Which resulted to this mess. Monster's money is going to court, and Rock Art's money is just going down the drain. f**k rich bastards.

damnnit, what a f**king peice of s**t company, f**k monster, im a red bull guy anyway, but still good point by this guy at the end, the population is in control, its the communication that we lack and u wouldn't think that would be a problem this day and age

nicely written, someone should send this to barrack obama since hes here for the small businesses...

i have never bought a monster anything, there not that good imo. i have tried them for free. yes there logo is pretty sweet looking on dirtbikes and cars but its a pretty messed up thing that they are willing to do to achieve the name for a beer.

I don't see the problem here at all.

What is being done is 100% legal and happens ALL THE TIME, this guy is just pissing and moaning about it. I remember a few years back here at school there was a real small diner that had a similar name to McDonalds, that were forced to change their name. These big companies have teams of people who look for similar names all day, in an effort to change them.
