noob w/ obd swapping question

so its illegal to swap in an engine thats older because they are not the same obd. for example, i have a 97 civic. legally i cant swap in the 2nd gen obd1 b16. so lets say i swap in the gen 3 obd2 b16. im legal. but then i hear about tuning ecu's. you cant chip the obd2 ecu. so most people say the p28 ecu is the ideal ecu to chip. but thats an obd1 ecu. would it not pass inspection and be illegal to be driving w/ it?

or is it just the engine that you have to worry about being older than the car.

that dont mean naything....check with your state laws. my bro has a OBD0 ZC it came from japan...japan doesnt have emmisions laws like we do. my state doesnt have Emissions testing at all. unless they phisically pull your panels apart and check i dont think it will matter.

If your state plugs into the OBD2 port and does a scan for emissions, then it obviously won't pass. But if they just do a visual inspection of your car.. I don't know anyone that is going to go through the hassle and look at the ecu. So you would be fine.

i ask because im sure everyone has heard the rule, you cant swap in an older engine w/ an older obd ecu in your car legally. thats why i ask. just wanted to make sure if i swapped in engine that matched or is newer than my car, and used an older obd ecu if it would still pass emission.

wait so if you plug in a obd1 ecu into a obd2 car itll pass? i thought obd2 was more advanced and it checked for more things (knock sensor, second o2)

if you plug it up doesnt it fail?

If your state/county hooks up to your ECU to scan for issues, and your car is supposed to have OBD2 and it does not, you will auto-fail. If you have a CEL, then you will auto-fail.

so basically there is no point in picking up the more expensive newer obd engines to match with the obd on your car if you are going to switch out the ecu anyways?

If your car is supposed to be OBD2 (96-00), and you have an OBD1 ECU in it, you will FAIL your emissions. They will hook up their OBD2 scanner to it, and since your OBD1 ECU doesn't know what the hell it's asking for, you will fail.
