title question

hey guys i need your thoughts and opinions. my friend decided to trade his car for this other guys car.the guy said the title was still in the mail cuz he hadnt had the car very long. they went ahead and traded exchanged info and wrote a bill of sale. my friend has the other guys car and the title to his car that the other guy has. the guy wont awnser the phone or call back and its been like 3 months and still no response from him. what is my friend supposed to do is there a way he can get the title?

I wish people would stop making these shady deals.

Either your friend or the guy your friend bought the car from has to go to the DMV office and order a new title for the car.

I don't know the laws in Illinois, but I'm pretty sure it's the previous owner that has to do, so your friend is pretty much SOL.

Seriously people are stupid. Im sorry but why the hell would anyone hand over money for a car when they are not being handed a title in return?? I wouldnt even do that if it were a Honda dealership.

LMAO. It's in the mail? That's what I told my girlfriend on our anniversary about her present.
2 Months later, she asked me where it was, I told her it was being shipped from Japan so it would take awhile.
Turns out, I got her a hug.

Seriously though, if you still have the title for your car and it has been put under the other guys name, try contacting him and tell him if you do not get the title for the car, you will report your car stolen. If he doesn't respond, report your car stolen. And wait for the car to be returned to you. When he contacts you because he's in jail, tell him you're going to give his car back and cancel the deal.

Here's the deal. The guy never handed over a Title. What I'm thinking is that the title for the that the OP's friend needs isn't even in the guys name that they traded from. Some people tend to buy cars, and get the Title, but never register it with the DMV because maybe they are illegals or they tend to get a lot of parking tickets. In the event the car gets a parking ticket or towed, the person whose name is still on the Title will be charged with the fines, not the actual person that got it.
So, the car that the OP's Friend is driving is not in his name and not in the traders name. It's probably still in the name of the guy the trader got the car from.
The car that the Trader is driving is still in the OP's friend's name.
Either way, the Trader's not paying any fees or fines or insurance.
What do you think?

I'm originally from Salinas, CA and it's a very common thing for this to happen.

Yeah, the wording is very ambiguous, though I interpreted the sentence like you did.

Not in my experience. Most people are reasonable. You just must be extremely cautious in any financial deal.

So, the car that the OP's Friend is driving is not in his name and not in the traders name. It's probably still in the name of the guy the trader got the car from.

When you sell your car, you should complete the deal at the DMV so that when money and the title are exchanged, you then immediately register the car in the seller's name to avoid the potential problems you mention here.

But either way, the guy doesn't have to turn in the bill of sale.
The OP's Friend should go to the DMV and check the registered owner of the car he is driving. If it's a name other than the guy he traded with, most likely the situation I described is happening to him.

Aside from using bad judgment in a shady trade, as Jolly mentioned, I also don't understand why the friend has let this go for 3 months. The longer this goes on, the more difficult it will be to resolve. It's past time for the friend to talk to a lawyer and get some sound legal advice.

This massive mistake should help the friend grow up and hopefully avoid similar bad situations in the future.

Unless the kid obtains a MAJOR amount of common sense, it doesnt look like he will be avoiding situations like these.....

lol thanks for a little bit of good advice. he obviously is going to learn a lesson from this.. he does have the title to the car the other guy is driving.. he doesnt have a title for the car the guy traded him. so go to the dmv see who the car is registered to is step one. then if its not the guy hetraded with report his car stolen?
