cant it be allowed because it in itself is an app? the name of the app can be trademarked right? just like a store called savemart? or kmart? i think its the same thing as the ipod, many people call mp3 players an ipod right?

It's not fanboyish even though I do clearly have a bias towards apple. The term app store was made famous by the marketing and devices from apple. They legaly own the term. I don't care how often people use it the term belongs to apple in a business sense. Just like a tissue is called a klenex and some people refer to any operating system on a computer windows. Eveyone needs to deal with stuff like this. No need to be mad at Apple when they are legally right in this situation.
