And when did Rock Art Brewery start to brew their beer?

He didn't use their name. It's not even the same name. If it were the same name, Rock Art started making their beer first. So, how did they use 'the monster' name to get sales, when monster energy drinks were non-existent during it's time of conception?

I watched the video, and quit about a minute in, all I heard was "b***h b***h, whine whine". Monster has their name trademarked, he used "Vermontster" which still has the Monster sound to it.

There are 8 or 9 elements for infringement, some are similarity of the marks, evidence of actual confusion, and likelihood of expansion. The confusion does not have to be from the consumers either.

Monster had the upper hand in this case, they withdrew from the fact that the infringement was not causing much loss of money if any.

Honestly, lawyers these days aren't like they used to be. They are trained to sue for anything and get as much money as they can. They don't know the laws like some of the old timers do.
